General Terms and Conditions (GTC)
1. Scope of Application
These General Terms and Conditions (GTC) apply to all business relationships between Ogieva Michael, Oni Gareson (hereinafter referred to as the "Contractor") and their respective contracting party (hereinafter referred to as the "Client").
They apply to all current and future contractual agreements.
By accepting the offer, the Client agrees to the Contractor’s GTC. Deviating terms shall only become part of the contract if expressly confirmed in writing by the Contractor.
Changes or additional agreements are only valid if confirmed in writing by the Contractor.
2. Offer and Conclusion of Contract
The Contractor provides the Client with a written and time-limited offer.
The contract is concluded upon the Client’s acceptance of the offer.
Services are provided by the Contractor directly or through designated assistants.
3. Cancellation of Orders
If an event cannot take place as planned, it must be canceled at least 48 hours before the agreed start time in writing (via email) or by phone.
If the cancellation is made less than 48 hours before the event, 50% of the agreed package price will be charged as a cancellation fee to cover already incurred planning, purchasing, and organizational costs.
By booking, the Client confirms agreement with these terms.
4. On-Site Requirements
The Client is responsible for the following conditions at the event location and bears all associated costs:

Power supply: Provision of a suitable power outlet in accordance with VDE standards in close proximity to the bar.

Weather protection: A covered area must be provided in case of rain.

Access and parking: Appropriate areas for loading/unloading, free parking spaces, and any required parking or event passes.

Permits: All necessary official permits and approvals must be obtained by the Client.

GEMA fees & venue protection: If music is played, the Client covers all related fees, especially GEMA fees. The Contractor assumes no liability. The Client is also responsible for protecting the venue (e.g., floor, walls) from damage such as scratches or spills.
5. Setup and Dismantling
Unless otherwise agreed, setup takes place on the day of the event or, if necessary, the day before. Dismantling is carried out immediately after completion of the agreed services.
6. Cocktail Selection
To avoid long waiting times, the number of cocktails offered is limited to a maximum of eight. A wider selection can be arranged upon request.
Any damages or loss of equipment (e.g., glasses) caused by the Client will be charged at replacement cost.
7. Payment Terms
The full invoice amount must be paid no later than 10 days after the event.
Available payment methods will be listed on the invoice.
In case of discrepancies, the Client must contact the Contractor immediately to find a solution.
In the event of late payment, the Contractor reserves the right to charge reminder fees.
8. Liability Disclaimer
The Contractor’s liability is limited to the amount covered by their business liability insurance.
Any further liability or warranty claims – regardless of the legal basis – are excluded unless intent or gross negligence on the part of the Contractor or their assistants can be proven.
The Contractor is not liable for delays or non-performance due to unforeseeable circumstances such as illness, accidents, theft, fire, or traffic delays.
The Contractor also accepts no responsibility for official permits not available at the start of the event.
9. Use of Names & Logos
The Client grants the Contractor permission to publish their company name and logo as a reference on www.myohanabar.com.
Additionally, the Client authorizes the use of their name and logo on the Contractor’s social media channels for showcasing provided services.
10. Travel Costs
Travel within a 50 km radius of our base is free of charge.
For distances beyond 50 km, a travel fee of €0.30 per kilometer is charged (round trip).
The shortest route according to common navigation systems is used as the basis for calculation.
11. Severability Clause
If any provision of these GTC or the contract is found to be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
In such a case, the invalid provision shall be replaced by the relevant statutory regulation.
Any changes or additions to these GTC must be made in writing.
By confirming the order, the Client agrees to these GTC.
